The National Organization of Collective Law Firms, analysis of a new paradigm from Cooperativism

Abstract

This research aims to confirm the cooperative aspects that distinguish the functioning of the National Organization of Collective Law Firms in order to define its type of ownership. We base this study on an analysis and comparison of the concepts, characteristics, and functioning of the organization and of cooperatives. We conducted a qualitative investigation that involved reviewing regulations and documents issued by Central State Administration bodies and the Central Committee of the Communist Party of Cuba, as well as analyzing, comparing, and synthesizing information. The main results highlight that both types of organizations constitute economic entities with business legal personality, sharing a similar organizational structure and guiding principles for their operation. The research concludes that the National Organization of Collective Law Firms should be defined as a business-oriented cooperative ownership entity with respect to the means of production in the updating of its founding Decree-Law.
